Consumer Right to Cancel a Contract

(A consumer is any natural person who enters into a legal transaction for purposes that are predominantly unrelated to their commercial, business, or professional activities.)

You have the right to cancel this contract within 14 days without giving any reason.

The withdrawal period is 14 days from the date:

on which you or a third party designated by you, other than the carrier, took possession of the goods, if you ordered one or more items in a single order and they were delivered together;
on which you or a third party designated by you, other than the carrier, took possession of the last item, if you ordered several items in a single order and they are delivered separately;
on which you or a third party designated by you, other than the carrier, took possession of the last part of the shipment or the last item, if you ordered goods that are delivered in several parts or items.

You may use the attached model withdrawal form, though this is not mandatory.

To meet the deadline for withdrawal, it is sufficient to send notification of your exercise of the right of withdrawal before the deadline expires.

Consequences of Withdrawal

If you withdraw from this contract, we will refund all payments received from you, including delivery costs (except for additional costs resulting from your choice of a delivery method other than the cheapest standard delivery method offered by us), immediately, and in any case no later than 14 days from the date on which we received notification of your decision to withdraw from this contract. We will refund the payment using the same payment method used in the original transaction, unless expressly agreed otherwise with you; in no event will you incur any fees in connection with this refund.

We may withhold the refund for goods that can be shipped by parcel until we have received the goods back or until you have provided proof of their return, whichever occurs first.

We will collect goods that cannot be shipped by parcel.

You must return or hand over to us goods that can be shipped by parcel immediately, and in any case no later than within 14 days from the date on which you notified us of your withdrawal from this contract. The deadline is met if you send the goods that can be shipped by parcel before the 14-day period expires.

You will bear the direct costs of returning goods that can be shipped by parcel, as well as the direct costs of returning goods that cannot be shipped by parcel. The costs for goods that cannot be shipped by parcel are estimated at approximately 80.00 EUR within Germany and 350.00 EUR for international shipments. The actual return costs will be determined on a case-by-case basis.

You are liable for any reduction in the value of the goods only if such reduction results from handling the goods in a manner not necessary to ascertain their nature, characteristics, and functioning.

Reasons for Exclusion or Expiration of the Right of Withdrawal

The right of withdrawal does not apply to contracts:

for the supply of non-prefabricated goods, manufactured according to the consumer’s individual specifications or clearly tailored to their personal needs;
for the supply of goods that spoil quickly or whose expiration date would expire quickly;
for the supply of alcoholic beverages whose price was agreed upon at the time of the contract’s conclusion, but which can be delivered no earlier than 30 days after the contract’s conclusion and whose current value depends on market fluctuations over which the trader has no control;
for the supply of newspapers, periodicals, or illustrated magazines, with the exception of subscription contracts.

The right to withdraw from the contract expires prematurely in the case of contracts:

for the delivery of sealed goods that, for health or hygiene reasons, are not suitable for return if their seal has been broken after delivery;
o for the delivery of goods, if, after delivery, they have been inseparably combined with other goods due to their nature;
o for the delivery of audio or video recordings or computer software in sealed packaging, if the seal has been broken after delivery.

If you have requested that the provision of services for which the contract provides for payment of a price begin during the withdrawal period, you are obligated to pay us an appropriate amount, proportional to the scope of services provided up to the moment you informed us of your exercise of the right to withdraw from this contract, in relation to the total scope of services provided for in the contract.

Reasons for Exclusion or Expiration of the Right of Withdrawal

The right to withdraw from the contract does not apply in the case of contracts for the provision of services related to recreational activities, if the contract specifies a specific date or period of performance.

The right to withdraw from the contract expires in the case of a contract for the provision of services that obligates the consumer to pay a price, upon full performance of the service, if the consumer, prior to the commencement of performance, expressly agreed that the trader may begin providing the service before the expiration of the withdrawal period and confirmed their awareness that their right of withdrawal expires upon full performance of the contract by the trader.

The right to withdraw from the contract expires in the case of a contract in which the consumer has expressly requested that the trader visit them to perform repair work, upon full performance of the repair services, if the consumer, prior to the commencement of the service, expressly agreed that the trader would begin providing the repair services before the expiration of the withdrawal period.
